What is errors and omissions (E&O) insurance?

Errors and omissions insurance, also called professional liability insurance, protects your business if a client claims your work, advice, or services caused them a financial loss. It covers your legal defense costs, settlements, and judgments, whether or not the claim has merit.

  • Yes. Errors and omissions insurance and professional liability insurance are the same thing. Depending on your industry, you may also see it called malpractice insurance. The name changes by profession, but the protection is essentially the same.

  • It depends on your profession. In Massachusetts, LLCs and LLPs are required to carry professional liability coverage. Home inspectors must carry a minimum of $250,000 in aggregate E&O coverage. For other professions like real estate agents and attorneys, it may not be legally required but is strongly recommended, and clients or contracts may require it regardless.

  • Yes. E&O covers your legal defense costs even if the claim against you has no merit. That's one of its most important features. Lawsuits are expensive whether you're at fault or not.

  • No. A BOP covers general liability and property, but does not include professional liability. E&O is always a separate policy. We can write both for you.
