Massachusetts PIP coverage, explained.

Don’t know what PIP means on your auto policy? Here’s everything you need to know.

What is PIP coverage?

Personal Injury Protection (PIP) is a compulsory coverage on every auto policy in Massachusetts, providing a minimum of $8,000 in coverage per person to handle medical bills and lost wages regardless of fault.

As a no-fault state, this required coverage ensures that your own insurance policy covers injuries immediately following an automobile accident.

What is covered by PIP coverage

PIP provisions cover all reasonable expenses incurred within two years after the accident for necessary medical treatment, up to a limit of $8,000 per person. That $8,000 is split across a few categories:

Medical Expenses

  • This covers reasonable and necessary medical treatment resulting from the accident, including emergency room visits, ambulance fees, X-rays, surgery, dental work, and physical therapy. If you have private health insurance, PIP pays the first $2,000 in medical bills, and additional costs get billed to your health insurance. Deductibles, co-pays, and other out-of-pocket expenses can still be charged back to PIP for reimbursement.

Lost Wages

  • If your injury prevents you from working, PIP provides for 75% of your average weekly wages, drawn from the remaining balance of your $8,000 limit after medical expenses.

Replacement Services

  • After covering medical bills, any remaining funds can be used for replacement services, things like household help or childcare you'd normally handle yourself but can't because of your injury.

What is not covered by PIP coverage

PIP is built for immediate, practical needs. It does not cover:

Pain and Suffering

  • PIP does not provide compensation for pain and suffering, emotional distress, or other non-economic damages.

Vehicle Damage

  • PIP only covers injuries to people, not damage to your car. That's what Collision and Comprehensive coverage are for.

Long-Term or Catastrophic Injuries

  • PIP does not cover long-term injuries, primarily because they exceed the policy's limits. Once your injuries surpass what PIP can pay, your options shift toward a potential tort claim against the at-fault driver.

Here’s when PIP coverage steps in.

PIP shows up more often than most people realize. Here are a few common situations:

You're rear-ended at a red light.

  • Whiplash and similar injuries are some of the most common results of rear-end collisions, and PIP covers your medical expenses and lost wages regardless of who's found at fault. You don't wait around for an insurance investigation. PIP kicks in right away.

A pedestrian is struck crossing the street.

  • Pedestrians struck by a vehicle are entitled to PIP benefits from the vehicle's insurance, covering their medical and related costs. The driver's PIP coverage pays for the pedestrian's injuries, even if the pedestrian was partially at fault, since Massachusetts no-fault rules apply regardless of who caused the accident.

You're a passenger in a friend's car.

  • Passengers in the insured vehicle are eligible for PIP benefits, ensuring they receive medical care and necessary support after an accident, regardless of which driver caused the crash. You don't need your own auto policy to be protected here. The vehicle's PIP coverage protects you.

You lose control and crash, with no other car involved.

  • Even in a single-car accident with no other vehicle involved, PIP benefits still cover the driver's injuries and associated costs. PIP doesn't require another party to be at fault. It applies to your own mistakes too.

Multiple cars pile up in a chain reaction crash.

  • In accidents involving multiple vehicles, PIP benefits provide immediate financial relief for medical treatment and other necessary services, without everyone having to wait for fault to be sorted out among several drivers and carriers.

A family member is hit while riding in someone else's car.

  • Immediate family members living in the same household as the policyholder are often covered, even if they're injured while riding in another person's vehicle or as a pedestrian. PIP protection can extend to your household even when you're not the one driving or even in your own car.

Personal Injury Protection (PIP) FAQs

  • Yes. According to Massachusetts law, you cannot register a vehicle in Massachusetts without it.

  • Massachusetts law mandates a minimum PIP coverage of $8,000 per person per accident. That's the standard amount included on every Massachusetts auto policy.

  • Yes. PIP follows the vehicle you're in. If you're a passenger in a covered Massachusetts vehicle, you're entitled to PIP benefits from that vehicle's policy regardless of who's at fault.

  • You generally have two years to submit PIP claims. If you're considering a personal injury lawsuit beyond PIP, the statute of limitations is three years from the date of the accident. Don't wait. The sooner you report an accident and start treatment, the smoother your claim tends to go.

  • A PIP claim alone typically does not result in a surcharge. Surcharges are generally based on at-fault accidents as determined under Massachusetts's merit rating system, not simply filing for PIP benefits.

  • Generally yes. PIP is tied to your Massachusetts policy, so it can still help cover your medical bills even if the accident happens in another state.

The catch is that Massachusetts's rules about when you can sue the other driver don't necessarily carry over once you leave the state. What you're able to do beyond your PIP coverage will depend on the laws where the accident actually happened.
